1. Acceptance of the terms
By using this website you freely and voluntarily accept these Terms and Conditions, which form an integral part of any commercial transaction you carry out with MetalLink. If you do not agree with any of them, we ask that you do not use the site.
2. Nature of the service
MetalLink S.A., with registered address at Avenida Nacional, Calle 53 Frangipani, Panama City, Republic of Panama, is engaged in brokering the purchase and sale of ferrous and non-ferrous materials, such as HMS 1, HMS 2, copper and aluminium, in the Republic of Panama.
The publication of this site is for information purposes and does not in itself constitute a contractual offer.
3. Quotes and prices
- Quotes are indicative only.
- They are based on the information provided by the client and on market conditions at the time they are issued.
- Metal prices may change without prior notice.
- The final quote is subject to verification of the material through inspection and weighing.
- All prices are expressed in balboas or in the currency agreed between the parties.
4. Receipt and grading of the material
- The quality of the material is determined according to the commercial standard that applies and that has been agreed in writing.
- Grading is carried out on a representative sample and may require laboratory analysis when the volume or the destination justifies it.
- The final grading is the one applied at the time of weighing.
5. Weighing
- Weight is determined on a calibrated and verified scale, in front of both parties.
- The tare of the vehicle or container is deducted before determining the net weight.
- If there is a material difference between what was agreed and what was verified, the scale weight prevails.
6. Terms of payment
- Payment is made at the time of weighing, unless a written credit agreement is in place for higher-volume transactions.
- Payment may be made by bank transfer, in cash or by any other means the parties agree.
- Late payment generates default interest at the rate set by law.
7. Delivery and logistics
- Delivery takes place at the agreed location within the territory of the Republic of Panama.
- Transport, loading and unloading costs correspond to whichever party assumes them as agreed in writing.
- Risk transfers at the moment the delivery receipt for the material is signed.
8. Documentation
The parties undertake to issue and receive the documents required by Panamanian law applicable to the trade of scrap and metals, including dispatch notes, sales notes and the certifications required by the competent authority.
9. Liability
MetalLink is responsible for delivering the material in the agreed quantity and quality. It is not liable for indirect damages or for lost profit arising from market conditions or from fluctuations in the value of metals.
10. Intellectual property
The design, texts, images and all other content of this website belong to MetalLink or are used with authorisation. No reproduction, in whole or in part, is permitted without prior written authorisation.
11. Penalties
Breach of these terms, including the delivery of undeclared material or material of prohibited origin, entitles MetalLink to cancel the transaction and to take any action provided for by law.
12. Amendments
We may amend these Terms and Conditions at any time. The current version is the one published on this page at the time of acceptance.
13. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Panama. Any dispute is submitted to the jurisdiction of the corresponding courts of the city of Panama, the parties waiving any other jurisdiction that might correspond to them by reason of their registered addresses.
